Accepting these terms
These Terms of Service govern your use of the Baskt waitlist page and form an agreement between you and Baskt. By joining the waitlist, you agree to these Terms and our Privacy Policy. If you do not agree, do not join the waitlist.
The Baskt waitlist
The waitlist is used to provide news about Baskt, launch updates, early-access opportunities, and related announcements. Your position is based on when your email is verified. A position does not guarantee access to Baskt, a particular feature, a specific price, or a launch date. Joining the waitlist is free.
Eligibility and your information
You must be at least 13 years old to join. You agree to provide an email address that belongs to you and is accurate, and to update it if it changes. You may not submit information that belongs to another person without their permission.
Email communications
After you submit your email, we send a one-time verification code. By verifying your email and joining the waitlist, you agree that Baskt may email you waitlist updates, launch news, early-access opportunities, and related product updates. You can unsubscribe using the link in any email. Unsubscribing removes your entry from the active waitlist and stops future Baskt updates. Verification or other service emails needed to complete a pending request may still be sent.
Acceptable use
You may not interfere with the website, attempt unauthorized access, submit malicious or misleading information, or use the waitlist for unlawful purposes.
Our content
Baskt’s name, logo, designs, text, and other materials on this website are owned by Baskt or its licensors. We grant you a limited, personal, non-transferable right to view the website. You may not copy, modify, distribute, or commercially use our content without permission.
Disclaimers
The waitlist and its content are provided on an “as available” basis. We do not promise that the website will always be available, accurate, complete, secure, or error-free, or that Baskt will launch or provide any particular service.
Indemnification
You agree to defend, indemnify, and hold harmless Baskt and its owners, team members, and service providers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the waitlist or website, or your violation of any law or third-party right.
Limitation of liability
To the fullest extent permitted by law, Baskt and its owners, team members, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the waitlist or website. To the fullest extent permitted by law, Baskt’s total aggregate liability arising out of or relating to the waitlist or these Terms will not exceed fifty U.S. dollars ($50). Nothing in these Terms limits liability that cannot legally be limited.
Dispute resolution and arbitration
Please read this section carefully. It affects your legal rights, including your right to go to court.
You and Baskt agree to first try to resolve any dispute informally by contacting Basktapp@gmail.com. If a dispute is not resolved within 30 days, you and Baskt agree that it will be resolved by binding arbitration administered under the American Arbitration Association’s rules, rather than in court, except that either party may bring an individual claim in small claims court. Any arbitration will be conducted on an individual basis, and you and Baskt each waive any right to participate in a class, consolidated, or representative action. You may opt out of this arbitration agreement by emailing Basktapp@gmail.com within 30 days of first agreeing to these Terms, stating that you decline to arbitrate.
Governing law
These Terms are governed by the laws of the State of Tennessee and applicable federal laws of the United States, without regard to conflict-of-law rules. Subject to the arbitration agreement above, any dispute not subject to arbitration will be handled in state or federal courts located in Tennessee, unless applicable law requires otherwise.
General provisions
These Terms, together with the Privacy Policy, are the entire agreement between you and Baskt regarding the waitlist and supersede any prior agreements on this subject. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Baskt’s failure to enforce any provision is not a waiver of its right to do so later. You may not assign these Terms; Baskt may assign these Terms in connection with a merger, acquisition, or sale of assets.
